WASHINGTON DC (08/12/2024) –This week, the Institute for Energy Research (IER), along with 23 coalition partners, filed an amicus brief in Ohio v. Environmental Protection Agency (EPA). The brief supports petitioners challenging the legality of California’s Clean Air Act waiver and urges the Supreme Court to invalidate it.
The EPA’s decision to rescind the Safer Affordable Fuel-Efficient Vehicles Rule Part One: One National Program (“SAFE I”) rule and reinstate California’s Clean Air Act waiver for the zero-emission vehicle sales mandate violates the Constitution’s principles of federalism by unfairly privileging California over the other states. “California Governor Newsom’s extreme policies – like a ban on gas-powered cars and trucks – are ignorant to the needs and realities of most Americans. Despite California’s efforts to remake the country in its far-left image, American consumers value and deserve the freedom to make choices that best suit their budget, lifestyle, and needs. Our comments on this case reflect a commitment to the equal sovereignty of each state and seek to preserve choice in the automobile market. What happens in California should stay in California, especially when it comes to their damaging and costly green agenda.”
