WASHINGTON DC (08/12/2024) –This week, the Institute for Energy Research (IER), along with 23 coalition partners, filed an amicus brief in Ohio v. Environmental Protection Agency (EPA). The brief supports petitioners challenging the legality of California’s Clean Air Act waiver and urges the Supreme Court to invalidate it.

The EPA’s decision to rescind the Safer Affordable Fuel-Efficient Vehicles Rule Part One: One National Program (“SAFE I”) rule and reinstate California’s Clean Air Act waiver for the zero-emission vehicle sales mandate violates the Constitution’s principles of federalism by unfairly privileging California over the other states.
